Dear Mr. Fischer,

Please send me the appropriate forms to appeal to the "Building Board of Appeals" your
decision not to approve our Rumford fireplaces in Grand County.

After talking with you today I called Gary Finiol (303 692 3165) and Mike Silverstein (303
692 3113) who both reported that there had been no action on the Regulation #4 Critical
Review Team recommendations (now more than a year old) to revisit the masonry heater
definition and form a fireplace task group.

So, while our Rumford fireplaces meet the performance standard of 6.0 g/kg required by
Colorado Regulation #4, we are not on the list because we don't meet the definition used
for a "masonry heater".

Our options seem to be:

1) Push the Colorado Commission to act on the almost two year old recommendations of
the Regulation #4 Critical Review Team,

2) Re-test with channels in the flue (which no one thinks will effect the emissions) so that
we meet the current definition of a masonry heater (which no one thinks is an adequate
definition),

3) Appeal your decision and hope that you will personally check with Gary Finiol to
confirm that our Rumford fireplaces meet the performance standards required in Colorado
and are just as clean as other appliances on the approved list and hope that you will approve
our Rumfords based on the EPA certified test results rather than disapprove them over a
definitional technicality.

Toward that end I called City Manager, Lurline Curran, who told me there was a "Building
Board of Appeals" and that I should ask you for the proper forms for the appeal.
