"We took fireplaces out of Reg#4 as a result of your lawyer", reported Gary. "He probably did you a favor." Gary indicated that the department would oppose it but we are back to square zero - just like the masonry heater advocates were. We could go to the Commission and request their approval over the objections of the staff. Would Gary like anything objective I could send him about fireplace efficiency? Yes, "I'm a scientist. I'm not on anybody's side."

We decided to attend the Commission meeting on June 15th to see how it works - probably will say nothing. Then we may consider petitioning the Commission to approve Rumford fireplaces that meet the same performance standard that stoves and masonry heaters have to meet. Is efficiency an issue? Maybe but as Gary says, they don't require other appliances to test for efficiency. We could make a case for efficiency but maybe better to appeal to American and Colorado traditions - and point out that fireplaces are not used to heat with and so will not be used anywhere as much as stoves or heaters but can be used to heat efficiently if necessary in an emergency.

BEFORE THE
COLORADO AIR QUALITY CONTROL COMMISSION

Regarding Proposed Revisions to: Regulation Number 4: New Wood Stoves and the Use of Certain Wood Burning Appliances During High Pollution Days

SUBJECT: The Commission will consider a proposal to revise Regulation Number 4 to adopt a testing protocol for masonry heaters, to add a definition for exempt devices, to clarify definitions in the regulation, and to correct grammatical and typographical errors.

FEDERAL REQUIREMENTS: The federal act does not require the Commission to make any of the rule revisions that are the subject of this Notice of Public Rulemaking Hearing.

A proposed Statement of Basis, Specific Statutory Authority, and Purpose and a regulatory analysis (if one has been requested) will be available for inspection no later than five (5) days prior to the hearing. The proposed language for the rule revision is attached to and made a part of this notice.
