Los Altos Rules (Chapter 12.64)

7/30/12

Jim,

Thanks. It's going to get worse here. Palo Alto figured out the EPA/BAAQMD req'ts so no longer allowing any wood burning nor grandfathering in existing wood burning if moved or rebuilt. Ditto in Los Altos Hills. The loop hole for many towns is that some allow a wood burning fireplace if exterior in the landscape.

Best,
Fred

Jim,

We spoke briefly on Friday - but I just wanted to let you know again that Los Altos approved the wood-burning Rumford that I had shown on my drawings, so we are set! I appreciate all the conversations and help from you. I hope I can call you again if I have more questions, which I am sure I will.

I am going to make a shopping list for the Contractor to construct the Rumford, and will get in touch with dealers in the area for help.

Thanks so much - I will send you pictures when it's done!

Tanvi

Tanvi,

Sorry it took me so long to get back to you. I really enjoyed talking with you today. I think you know my Rumford fireplaces and my website about as well as I do.

I've added a listing for you on our architects page at http://www.rumford.com/arch.html and we will mail you a Catalog.

Please do let me know if Los Altos approves the Rumford and let me help if they don't.

Warm regards,
Jim Buckley

Jim,

Here is a link to the code:
http://ordlink.com/codes/losaltos/index.htm Please go to Section 12.64.030, which I have reproduced below:

12.64.030 Application.

A. Only gas fireplaces, pellet-fueled wood heaters, or EPA certified wood-burning appliances may be installed in new construction.

B. Excluded from these regulations are devices intended to be solely used for the preparation of food (i.e., wood-burning ovens and outdoor barbeques), and existing fireplaces.

C. Existing fireplaces, regardless of how many exist, may be used and maintained indefinitely. Once these existing fireplaces are removed, only gas fireplaces, pellet-fueled wood heaters, or EPA certified wood-burning appliances may be installed in thier place.

D. It is unlawful to burn garbage, plastics, rubber, paints, solvents, oil, treated wood products, particle board, coal or any other material that produces noxious or toxic emissions when burned in a wood-burning fireplace. (Ord. 03-253 4 (part): Ord. 01-404 2 (part))

12.64.20 Definitions.

B. "EPA certified wood-burning appliance" means any wood-burning device that meets the Code of Federal Regulation in effect at the time of installation and is certified and labeled pursuant to those regulations.

Please call me when you;ve had a chance to study everything. I am interested in the R4242, so I would appreciate that letter from you.

Thank you.
